Terms of Service

By accessing this website or engaging Kyte Studios for services, you agree to be bound by these Terms of Service. Please read them carefully before proceeding.

1. Services

Kyte Studios provides custom software development, AI automation, and workflow engineering services. The specific scope, deliverables, and timeline for each engagement are agreed upon in writing before work begins.

2. Engagement and Payment

Project initiation

All projects begin with a scoping call and a written proposal. Work commences upon receipt of the agreed deposit.

Payment terms

• A deposit (typically 50%) is required before work begins
• The remaining balance is due upon project completion and delivery
• Invoices are due within 14 days of issue
• Late payments may incur a 2% monthly interest charge

Refunds

Deposits are non-refundable once work has commenced. If Kyte Studios is unable to deliver the agreed scope, a pro-rated refund will be issued for work not completed.

3. Intellectual Property

Upon receipt of full payment, all custom code, workflows, and deliverables created specifically for a client project become the intellectual property of the client. Kyte Studios retains the right to use generic components, libraries, and methodologies developed independently.

Kyte Studios may reference the project in its portfolio (without disclosing confidential details) unless the client requests otherwise in writing.

4. Confidentiality

Both parties agree to keep confidential any non-public information shared during the engagement. This obligation survives the termination of the engagement for a period of 2 years.

5. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete requirements in a timely manner
• Timely feedback and approvals to avoid project delays
• Providing access to systems, tools, and credentials required for the build
• Ensuring they have the right to use any materials provided to Kyte Studios

6. Limitation of Liability

Kyte Studios is not liable for indirect, incidental, or consequential damages including lost profits or data loss. Our total liability for any claim arising from a project is limited to the total fees paid for that project.

7. Warranties

We warrant that our work will be performed with reasonable skill and care and will function as described in the agreed scope. We provide a 30-day warranty period after delivery during which we will fix bugs at no additional cost. This warranty does not cover changes to requirements, third-party service failures, or misuse.

8. Termination

Either party may terminate an engagement with 14 days written notice. Upon termination, the client will pay for all work completed to date. Kyte Studios will deliver all work completed at the time of termination.

9. Governing Law

These terms are governed by the laws of the jurisdiction in which Kyte Studios operates. Any disputes will be resolved through good-faith negotiation before any formal proceedings.

10. Changes to These Terms

We may update these terms from time to time. Continued use of our website or services after changes constitutes acceptance of the updated terms.
